Wellax SMS Terms of Service

IMPORTANT! PLEASE READ CAREFULLY.

BY PROVIDING YOUR MOBILE PHONE NUMBER TO WELLAX CONSULTING SERVICE (“COMPANY,” “WE,” OR “US”) OR CHANGING THE PHONE NUMBER ASSOCIATED WITH YOUR USE OF ONE OR MORE OF THE WELLAX CONSULTING SERVICE TEXT MESSAGING PROGRAMS, YOU AGREE TO ABIDE BY AND BE BOUND TO THESE SMS TERMS OF SERVICE. THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER.

Consent to Receive Text Messages

By providing your mobile phone number, you expressly consent to receive marketing or non-marketing text messages, including those sent using an automatic telephone dialing system (“autodialer”), at the number(s) you provide. Consent to receive text messages is not required as a condition of any purchase. You may opt out at any time.

Program Description

1. You will receive SMS messages at the mobile number you provided.

2. Messages may include but are not limited to appointment reminders, service updates, important notifications, and promotional offers.

3. We may also send you updates about new services, policy changes, and other business-related information.

4. You agree not to use Wellax Consulting Service’s SMS program for any illegal or unlawful purposes.

Message Frequency

1. The number of messages will vary based on the services you engage with.

2. Transactional messages will be sent per event (e.g., appointment confirmations, reminders, and status updates).

3. Promotional messages will be limited to a maximum of three per week.

Cost

Wellax Consulting Service does not charge for SMS messages, but message and data rates may apply as per your mobile carrier’s plan.

Opting In

To opt-in for text messages, follow the instructions provided by Wellax Consulting Service when signing up.

Opting Out

1. To stop receiving promotional messages, reply “STOP” to our messages.

2. To stop receiving all messages except essential transactional texts, contact our support team directly.

3. You will receive a final confirmation message upon opting out.

Your Mobile Telephone Number

You agree that you have the authority to provide your mobile number and will update us if your number changes. You also agree to indemnify Wellax Consulting Service for any claims arising from failure to notify us of such changes.

Access & Delivery Not Guaranteed

1. Your mobile carrier must support SMS for you to receive messages.

2. We are not responsible for delays or failures in message delivery due to network issues.

Supported Carriers & Availability

1. Supported carriers may change over time.

2. SMS services are currently available only in the United States and Canada.

Changes to Terms

We reserve the right to modify these SMS Terms of Service at any time. Changes will be posted on our website, and continued use of our SMS program constitutes acceptance of the revised terms.

Termination of SMS Services

We may suspend or terminate SMS services if we believe there is a violation of our terms or if your mobile service is discontinued.

Privacy

By opting in, you consent to receive SMS messages for informational and promotional purposes. Your information will not be shared with third parties without your explicit consent, except as required by law. See our Privacy Policy for details.

Limitation of Liability

By opting in, you release Wellax Consulting Service from liability related to the use of our SMS program. We provide the service “as is” and disclaim all warranties, including fitness for a particular purpose.

Arbitration & Class Action Waiver

All disputes related to our SMS Terms of Service must be resolved through arbitration, with no class actions permitted. Mediation is required before arbitration, and the arbitration will be governed by the laws of the state where Wellax Consulting Service is registered.

Severability

If any part of these terms is found to be unlawful, the rest of the terms will remain binding.

If you have consented to receive text messages from Wellax Consulting Services Inc, you may receive messages related to the following:
